We try to keep our Services as friendly, efficient and free of legislation as possible. However, in using Ciscom as your web Services provider, you agree to comply with the following Terms and Conditions. Among other reasons, this is to protect Ciscom and all customers from irresponsible use of the web space and Services.

Terms of Service

Ciscom provides World Wide Web page hosting and other Services. Ciscom reserves the right to suspend or cancel a customer's access to any or all Services provided by Ciscom when Ciscom decides that the account has been inappropriately used or otherwise.

Server Use

Personal accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Ciscom reserves the right to refuse service and /or access to its servers to anyone. Ciscom do not allow any of the following content to be stored on its servers:

  • Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
  • Search Engine Banned or Search Engine Unfriendly Content and Practices - This includes hidden pages, deliberate multi-repeated words, hidden text in the same colour as the background, spamming of search engines and so on.

Unlimited Use Policy

High bandwidth usage: Ciscom offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, Ciscom may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, Ciscom reserves the right to impose the High Resource User Policy for the consideration of all customers.

High Resource User Policy

Resources are defined as bandwidth and/or processor utilization. Ciscom may implement the following policy to its sole discretion: When a website is found to be monopolising the resources available Ciscom reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Ciscom continues hosting the website for an additional fee.

Domain Name Registration

Domain names are registered on your behalf in your name or the name of your business. You are the registered owner of the domain name unless agreed otherwise. When we register a domain name for you, it will automatically renew after the period prescribed by the registration authority. This is normally every two years for .uk domains and every one year for Top Level Domains (Tld) such as .com. If you no longer require the domain name, you must tell us at least 60 days before the renewal date. You agree to pay the domain name renewal cost until such time as you give us notice that you no longer require the domain name. If you give us sufficient notice that you no longer require the domain name, it will expire at the next renewal date and will be available for registration by a new owner. If you do not pay for your domain name, Ciscom will mark it for expiry at the next renewal date.

Payment Policies

All accounts are set up on a prepay basis. Although Ciscom reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given. In situations where the card number on file is declined Ciscom will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, Ciscom reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request. No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.

All payment is in UK sterling.

The price you pay is the price displayed on this website at the time we receive your order or the price we have previously agreed apart from the following exception. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods or services you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods or services, you will receive a full refund. Payment can be made by any method specified below.

We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you. The contract between us shall be governed by the laws of England and Wales and any dispute between us will be resolved exclusively in the courts of England and Wales.

Ciscom operates the following payment options:

  • Bank Transfer (BACS): This is the preferred method of payment. Bank details are provided on our invoice or provided on request for BACS payments.
  • Standing Order: This option is available at the discretion of Ciscom for certain services such as website hosting. Ciscom cannot guarantee that a service will be provided until after any received cheques have been cleared.
  • Cheque Payment: This option is available at the discretion of Ciscom. Please pay by BACS to avoid the administration involved in banking a cheque. Please do not pay small invoices by cheque. Ciscom cannot guarantee that a service will be provided until after any received cheques have been cleared.

Cancellation and Refunds

Ciscom reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes Ciscoms' Terms and Conditions a refund will not be issued in the event of a cancellation.

Customers may cancel their account at any time. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation. Fees charged on a prepay basis are non-refundable. In addition some accounts incur set-up fees, these charges are non-refundable.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold Ciscom harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Ciscom, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Ciscom against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Ciscom' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Ciscom servers.

Disclaimer

Ciscom will not be responsible for any damages your business may suffer. Ciscom makes no warranties of any kind, expressed or implied for services we provide. Ciscom disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Ciscom and its employees. Ciscom reserves the right to revise its policies at any time.

Information Provision

Information provided in any area of this web site or by email response is for general guidance only. We will take all reasonable precautions to ensure that the information is accurate and up to date. However, no liability can be accepted by us for loss, damage or injury caused by any errors in, or omissions from, the information given.

Data Protection

Using our Services and the internet in general will require you to provide us with your name and address and other relevant information. Personal information provided by you, and any other information relating to you, will be held by Ciscom and if you have indicated your acceptance, may be used for marketing purposes, including market research, or occasionally shared with other organisations in the prevention of fraud. We may also share your personal information with carefully selected third parties who may contact you for marketing purposes by mail, telephone or email.
